These terms apply to the Lingua Live app ("the app", called 听懂 in Chinese) and the Lingua Live cloud service, provided by chirpet.com ("we"). The app is licensed to you under Apple's Licensed Application End User License Agreement (the "Standard EULA"); these terms add to it. Where they differ, these terms apply to the service and the Standard EULA applies to the app license.
The service
The free version translates on your device with Apple's engines and includes 10 minutes of live listening per day. Text and photo translation are not limited.
Pro and Max are auto-renewable subscriptions. They remove the daily limit and include cloud speech recognition, translation and summaries up to the plan's monthly cloud time (Pro 10 hours, or 2 hours per week on the weekly plan; Max 40 hours). Unused time does not carry over.
We may change or improve features and the AI providers we use. If a change reduces what a paid plan includes, we give notice in the app before your next renewal.
Subscriptions and payment
Payment is charged to your Apple ID when you confirm the purchase. A subscription renews automatically at the same price and period unless you turn off auto-renew at least 24 hours before the end of the current period.
A free trial, when offered, converts to a paid subscription at its end unless you cancel at least 24 hours before; any unused part of a trial is forfeited when you buy a subscription.
Manage or cancel subscriptions in the App Store account settings on your device (also reachable in the app: Settings › your plan › Manage Subscription). Refunds are handled by Apple under its policies.
Your subscription works on every device signed in with the same Apple ID; Restore Purchases reconnects it.
Acceptable use
Use the app lawfully. If you record or transcribe other people, you are responsible for any notice or consent the law requires where you are.
Don't misuse the cloud service: no attempts to bypass plan limits, overload it, reverse engineer it, or use it to build a competing service. We may suspend cloud access in case of abuse.
Accuracy
Speech recognition, translation and summaries are produced automatically and can be wrong or incomplete. Don't rely on them alone for medical, legal, safety-critical or other important decisions.
Your content and privacy
You keep all rights to what you say and type. We process it only to provide the service, as described in the Privacy Policy. We do not store your audio.
Liability
The app and the service are provided "as is". To the extent permitted by law, we are not liable for indirect or consequential damages, and our total liability is limited to the amount you paid for the service in the twelve months before the claim. Nothing in these terms limits rights you have under consumer protection law.
